1. Acceptance of terms
Welcome to Meditome Diagnostics! By accessing or using our website and services, including the facilities provided at our centre: SK Polyclinic and Accurate Diagnostic Centre, 99 CSP DDA Flats Safdarjung Enclave, Near Shree Ram Mandir of B 5 Block, New Delhi 110029, India, you agree to comply with these terms of service (the “terms”). 2. Our services
Meditome Diagnostics arranges collection of blood and other samples through its partner laboratories and SK Polyclinic and Accurate Diagnostic Centre. The diagnostic reports are then distributed by Meditome to the respective patients. Meditome does not conduct laboratory testing or analysis and is not responsible for the accuracy or completeness of the diagnostic reports provided by the partner laboratories. The information and services provided are intended for users located in jurisdictions where such use is lawful. Users accessing the services from outside these jurisdictions are responsible for ensuring compliance with local laws.
3. Intellectual property rights
Meditome Diagnostics has submitted a trademark application for its trade name, “Meditome Diagnostics.” While the application is pending approval, the trade name is protected under applicable intellectual property laws as a pending trademark. The use of “Meditome Diagnostics” in any manner that implies endorsement, association, or affiliation without explicit consent is strictly prohibited. Unauthorized use of the trade name may result in legal action, including claims for damages and injunctions. 4. User responsibilities
By accessing or using the services, you represent and warrant the following:
- Legal Capacity: You have the legal authority and capacity to enter and comply with these legal terms.
- Age Requirement: You are not a minor in the jurisdiction in which you reside, or if you are, you have obtained necessary parental or guardian consent to use the services.
- Authorized Access: You will not access the services using automated or non-human methods, such as bots, scripts, or similar technologies.
- Lawful Use: You will use the services only for lawful purposes and in accordance with these legal terms.
- Accuracy of Information: Any information you provide to us will be accurate, complete, and up to date. If any information provided by you is found to be false, incomplete, or outdated, we reserve the right to suspend or terminate your access to the services and refuse any future use of the services (or any portion thereof).

Any violation of these terms may result in immediate termination of access to the services, and we reserve the right to take legal action where appropriate.
6. Contribution license

- Indemnity: You agree to indemnify and hold us harmless for any claims, damages, or liabilities arising from your contributions, including violations of third-party rights or applicable laws.
- No Responsibility for Inaccuracies: Meditome Diagnostics is not responsible for any inaccuracies, errors, or misrepresentations within your contributions. You remain solely responsible for the content of your submissions.
7. Service management
We reserve the right, but not the obligation, to:
- Availability and Performance: Meditome Diagnostics will make reasonable efforts to ensure the availability and performance of the services, including the appointment booking system and access to diagnostic reports. However, we do not guarantee that the services will be uninterrupted, error-free, or fully secure.
- Service Interruptions: Meditome Diagnostics reserves the right to suspend or interrupt the services for maintenance, system upgrades, or other technical reasons. We will attempt to provide prior notice of any planned service interruptions, but such notifications may not always be possible. Service availability may also be affected by external factors beyond our control.
- Updates and Modifications: We may update, modify, or discontinue the services at any time, including changes to service offerings, pricing, or system functionality. Such changes may affect the availability or features of the website, including the booking system or report access.
- Support and Assistance: While Meditome Diagnostics provides support for booking appointments and accessing reports, we do not guarantee immediate resolution of issues. Support may be subject to availability and the complexity of the issue.
- Disclaimer: Meditome Diagnostics is not liable for any interruptions, delays, or errors in the provision of the services, including issues with the appointment booking process or access to reports. We are not responsible for any loss or damage arising from the unavailability of the website or service disruptions.
8. Term and termination
a) Agreement Binding: By using the website or accessing any services provided by Meditome Diagnostics, you agree to be bound by these terms of service. If you do not agree to these terms, you should not use the website or the services.
b) Termination by Meditome Diagnostics: Meditome Diagnostics reserves the right to suspend or terminate access to the website and services at any time, without notice, for any reason, including but not limited to:
- Violation of these terms and conditions
- Misuse of the services
- Any other reason deemed necessary by Meditome Diagnostics
Upon termination, your access to the website and services will be immediately revoked, and any pending appointments or reports will be affected.
c) Termination by User: You may terminate your use of the website and services at any time by discontinuing your use of the website or canceling any appointments, if applicable. Termination by the user does not affect any liabilities incurred prior to termination.
d) Effect of Termination: Upon termination of these terms, the following provisions will survive:
- Any outstanding obligations of the user, including payments for services already rendered.
- Any provisions regarding liability, dispute resolution, and other necessary legal clauses.
e) Modifications to Terms: Meditome Diagnostics reserves the right to update or modify these terms at any time. Changes will be posted on the website, and it is your responsibility to review them periodically. Continued use of the website and services after changes are posted constitutes your acceptance of the modified terms.
9. Governing law
These legal terms and your use of the services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You irrevocably agree that any disputes arising from or related to these legal terms will be subject to the exclusive jurisdiction of the courts located in Delhi, and you waive any objection to such jurisdiction or venue. All claims or disputes will be resolved in accordance with the governing law, unless explicitly stated otherwise in these legal terms.
10. Dispute resolution
Any dispute, controversy, or claim arising out of or in connection with these terms (“dispute”) shall first be resolved through good-faith discussions between the parties for at least 30 days from the date written notice of the dispute is provided by one party to the other.
If the dispute is not resolved within this period, it shall be referred to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall take place in Delhi, and the proceedings shall be conducted in English/Hindi. The decision of the arbitrator(s) shall be final and binding on both parties.
The governing law of this agreement shall be the laws of India, and any claims not subject to arbitration, including those related to intellectual property rights or injunctive relief, shall fall under the exclusive jurisdiction of the courts in Delhi.
The parties agree that arbitration shall be limited to disputes between them and waive any right to participate in class-action or consolidated proceedings.
11. Corrections
There may be typographical errors, inaccuracies, or omissions on the services, including but not limited to descriptions, pricing, and availability. We reserve the right to correct these errors and to update or change the content of the services without prior notice.
12. Limitation of liability
- To the fullest extent permitted by law, Meditome Diagnostics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or business opportunities, arising out of or in connection with your use of or inability to use the services, even if Meditome Diagnostics has been advised of the possibility of such damages.
- In no event shall the total liability of Meditome Diagnostics to you for any direct damages arising out of or related to these terms exceed the total amount paid by you to Meditome Diagnostics for the services immediately preceding the event giving rise to the liability.
- Meditome Diagnostics shall not be held responsible for any services, content, or materials provided by third parties, including the partner laboratories, which may be linked to or integrated with the services.
13. Indemnification
You agree to defend, indemnify, and hold us harmless, including our owner, employees, and agents, from any loss, damage, liability, claim, or demand, including legal fees and expenses, arising from:
- Your use of the services.
- Your breach of these legal terms.
- Any breach of your promises or representations in these legal terms.
- Your violation of third-party rights, including intellectual property rights.
- Any harmful actions you take toward other users of the services.
We may take control of the defense in these situations at your cost, and you agree to cooperate with us in defending such claims. We will make reasonable efforts to notify you about any claim or legal action that requires your indemnification.
14. User data
We maintain data you transmit to the services for the purpose of managing the platform’s performance. While we regularly back up data, we are not responsible for any loss or corruption of your data. You are solely responsible for your own data.
15. Electronic communications, transactions and signatures
- By using our services, sending us emails, or completing online forms, you are engaging in electronic communications. You agree to receive communications from us electronically, including agreements, notices, disclosures, and other important information. You acknowledge that these electronic communications satisfy any legal requirement that such communications be in writing.
- You consent to the use of electronic signatures, contracts, orders, and other records in connection with transactions initiated or completed via the services. You also agree that notices, policies, and records of these transactions will be delivered electronically.
- You waive any rights or legal requirements that would require a physical signature, or the delivery or retention of non-electronic records, or payments and credits to be made through non-electronic means.
16. Miscellaneous
- These legal terms constitute the entire agreement between you and us. Any failure to enforce a provision does not constitute a waiver of that provision.
- These legal terms operate to the fullest extent permitted by law. If any provision is found to be unlawful or unenforceable, it shall be severed, and the remaining provisions shall remain in effect.
- No partnership, joint venture, or agency relationship is created by these legal terms. These legal terms shall not be construed against the drafter.
- Meditome Diagnostics is not liable for failure to perform due to circumstances beyond its control, such as natural disasters or technical failures.
17. Disclaimer
The services are provided “as-is” and “as available.” You use them at your own risk. To the fullest extent allowed by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy or completeness of the services’ content, and we are not responsible for:
- Errors, mistakes, or inaccuracies in the content and materials.
- Personal injury or property damage resulting from using the services.
- Unauthorized access to our secure servers or your personal or financial information.
- Any interruption or issues with the transmission to or from the services.
- Bugs, viruses, or malware transmitted via the services by third parties.
- Loss or damage caused by content posted or transmitted through the services.
